Description

An historically important document dated 26th September 1963 which was prepared by Silverman, Liverpool & Co, Solicitors for Brian Epstein. It is titled ‘Nems Enterprises Limited and The Beatles – Opinion’.
The document is an Opinion prepared by Brian’s solicitor David Harris of Silverman, Livermore & Co and analysed by a barrister-at-law named Henry Lachs. It relates to the management contract The Beatles had signed with Nems Enterprises Ltd on 1st October 1962 and with particular relevance to George Harrison and Paul McCartney who were deemed infants (aged 21 or under) in the eyes of the law. It has been signed in blue pen by Henry Lachs on the final page.
Beatles historian Mark Lewisohn offers the following thoughts on why this legal opinion may have been commissioned by Brian Epstein:
‘What’s clear is that during September 1963 – for reasons we don’t know for certain and probably never will – Brian Epstein was prompted to seek reassurance about the tightness of his management contract with The Beatles, specifically with regard to those deemed infants in the eyes of the law, Paul and George. He asked his solicitor – David Harris of Silverman, Livermore & Co – to have it analysed by Counsel, a barrister-at-law, a man named Henry Lachs, and this document is that man’s Opinion. I know from having discussed it with David Harris that Brian was reassured by what he read, and consequently no further action was taken. Feeling more comfortable with the situation, Brian left it there – rightly, as it turned out, since it never became an issue.’
The document consists of 6 sides of typed information and a title page stapled together in the upper left corner. It measures 20.5cm x 25.5cm (8 inches x 10 inches). The document has been folded leaving a vertical crease through the centre. The condition is very good.
